27 farm406 may be brief, but for Preliminary Decrees, which also include compacts between sovereigns such as other states, tribes, and the United States, as well as all water rights claims in a basin, the adjudication process can take years to move to a Final Decree finally. In the Final Decree, each water right will include flow rate, priority date, beneficial use, time and place of use, source of water, and place and means of diversion. When this process of issuing Final Decrees for all water basins is complete, questions will likely continue. Confusion remains as to whether the district courts can administer the Final Decrees with federal or tribal entities. Furthermore, fresh conflict over water will continue as changes in land use, weather cropping paerns, urban population growth, and shis toward more recreational use will couple with high-demand variability in the water supply. "e guidelines that have been worked out are laudable, not because they are perfect but because they will make resolution by district courts of future problems easier by providing beer-defined water rights as a starting point for conversation," wrote the present Water Judge, Russell McElyea, in a report. No other state does any beer. is article is wrien only as a historical overview of adjudicating water rights in Montana, emphasizing surface water that farmers and ranchers might use.
