Two simple policies that affect every business are workers compensation insurance and your unemployment compensation rate. How would the firing of a contingent employee deemed to be your employee affect your state and federal unemployment compensation rate or to what extent would your workers' compensation in- crease from unrealized employee payroll or a worksite injury? What if an injured employee were denied treatment because the employer assumed the injured party was a temporary employee and the claim would go to the Temporary Employer Policy? But under the new definition, if a late-reported claim were covered by the policy, the employee's injury would be included on the company's workers compensation mod. These are simple examples of the effects of who is an employee; the complications come forward when the employer attempts to classify the employee into the many federal laws that pertain to employees and employee rights. Under federal law, once the worker is determined to be an employee then his or her initial hiring date and length of service will determine which laws are applicable at any given time. Failure to make an employee aware of his or her rights, usually in writing, will significantly increase the penalty for a violation that occurs or is alleged to have occurred. The possibility of tripping up on one of the EEOC discrimination cases is highlighted by one section taken from the EEOC Web site: "It is also illegal for an employer to recruit new employees in a way that discriminates against them because of their race, color, religion, sex (including STORM SECURITY P R O T E C T I O N & NEXT ISSUE: 2016 DIRECTORY & BUYER'S GUIDE INDUSTRY LEADERS IN STORM & SECURITY PROTECTION Storm & Security Protection MAGAZINE • Advertising Rates • Editorial Schedules • Digital Edition Information Kerri Caldwell Publisher / National Sales (773) 775-9293 Publisher / National Sales kcaldwell@kasnicmedia.com stormsecuritymag.com
