If the claimant or his attorney find out about the situation and file an application for penalties and updated compensation, this is an opportunity to request a hearing and litigate on the issue of imposition. Discovery can then be propounded upon the claimant demanding all of his employment history as well as changes in address. Settlement should then be attempted.
