Life Expectancy Table In valuing a case for settlement, it is often necessary to determine how long an injured worker is expected to live in order to determine exposure for future medical treatment or the extent of exposure for a permanent and total disability claim. Virginia Code Section 8.01-419 contains a table of life expectancy that is useful in making these assessments. This Section can be found here. C. Forms The Virginia Workers' Compensation Commission maintains forms on its website that are useful in adjusting claims and defending workers' compensation claims. Those forms can be found here. D. Historical Benefits When dealing with older claims, we find the table found here to be a very useful reference tool. It outlines historical maximum and minimum compensation rates, percentage of the average weekly wage used to calculate the compensation rate, cost of living adjustments, periods of medical awards, maximum periods for compensation benefits, limits for burial and funeral expenses, and mileage rates.
