US FDA considering labeling for sesame allergies S I LV E R S P R I N G , M A R Y- LAND—e United States Food and Drug Administration (FDA) is considering requiring food labeling for sesame. US federal law currently requires that foods con- taining one of the eight "major food allergens"—milk, eggs, fish, shellfish, tree nuts, peanuts, wheat and soybeans—declare the food source of the allergen, using its common or usual name, on food labels. Sesame is not recognized as a major allergen and is therefore not required to be declared as an allergen on food labels. It also may not be specifically listed in ingredi- ent statements. Products listing "natural flavors" or "spices" may contain small amounts of sesame and tahini is a paste made from sesame seeds. In an FDA state- ment, Commissioner Scott Got- tlieb, MD explained that a handful of studies suggest that the preva- lence of sesame allergies in the US is more than 0.1 percent, on par with allergies to soy and fish. As a first step, the agency has issued a request for information to learn more about the prevalence and severity of both sesame allergies and sesame-containing foods sold in the US. Specifically, they are seeking information from epide- miologists, nutritionists, allergy researchers, physicians, the food industr y and consumers. The information will also inform the FDA's response to a citizen's peti- tion asking the FDA to require that sesame-based ingredients be listed specifically by name on the ingredient lists of all food labels. Canadian study concludes food bans not legally required in schools E D M O N T O N , A L B E RTA , C A N A D A — H a v i n g a f o o d allergy is legally considered a dis- ability that must be accommo- dated in Canadian schools, but food bans are not legally required, according to a study led by the University of Alberta's (U of A) H e a l t h L a w I n s t i t u t e . Fo l i o re p o r t e d t h a t t h e re s e a rc h e r s examined the Canadian Charter of Rights and Freedoms, Supreme Court of Canada rulings, recent federal and provincial human rights legislation, and case law to identify instances where Cana- dian courts clearly determined f o o d a l l e r g y w a s a d i s a b i l i t y. "Some schools have implemented food bans, but recent scientific evidence does not consistently support bans as the most effective way to protect allergic children from accidental exposure to aller- gens," said co-author Eric Adams, an associate professor at the U of A's Faculty of Law. Led by research director Timothy Caulfield, the researchers concluded there is no need for one definitive model to deal with allergies. "Important protections for allergic students and the school community will continue to include education about food sharing, vigilance and adequate emergency response mechanisms," said Blake Mur- doch, research associate and study first author. "Of course, if the sci- entific evidence changes in the future, the law around food bans could change with it." e study, "The Law of Food Allergy and Accommodation in Canadian Schools," was funded by AllerGen NCE and published in Allerg y, Asthma & Clinical Immunology.
