Use of technolog y resources for non-MCCCD commercial purposes, including to adver tise personal ser vices, whether or not for f inancial gain. 7. Use of sof t ware, graphics, photographs, or any other tangible form of expression that would violate or infringe any copyright or similar legally-recognized protec tion of intellec tual proper t y rights. 8. Ac tivities that would constitute a violation of any polic y of MCCCD 's Governing Board, including , but not limited to, MCCCD 's non- discrimination polic y and its polic y against sexual harassment. 9. Transmit ting , storing , or receiving data, or other wise using technolog y resources in a manner that would constitute a violation of state or federal law, or MCCCD polic y or administrative regulation including , but not limited to, obscenit y, defamation, threats, harassment, and thef t. 10. At tempting to gain unauthorized access to a remote net work or remote computer s ystem. 11. Exploiting any technolog y resources by at tempting to prevent or circumvent access, or using unauthorized data protec tion schemes. 12. Per forming any ac t that would disrupt normal operations of computers, workstations, terminals, peripherals, or net works. 13. Using technolog y resources in such a way as to wrong fully hide the identit y of the user or pose as another person. 14. Allowing any unauthorized access to MCCCD 's technolog y and non-technolog y resources. 15. Making personal long distance or other toll calls, except where the charges for the calls are incurred direc tly by the caller or arrangements are other wise made at the time of the call to direc tly bill the caller. 16. Intermit tent use of technolog y resources that inter feres with the per formance of an employee's main responsibilities. 17. Use of technolog y resources to market or conduc t other ac tivities on behalf of a third-par t y regarding the "hosting " of an event that is prohibited under MCCCD 's Use of College Facilities administrative regulation. 18. Conduc ting Distric t or college-related business using any elec tronic mail account other than one hosted or provided by MCCCD, and approved by the Vice Chancellor of Information Technolog y Ser vices, even when the e-mail account copies all out going and incoming messages to the MCCCD hosted account. 19. Deleting or altering a technolog y public record in violation of public records retention requirements, or in anticipation of receiving or af ter receipt of a public records request, subpoena, or a complaint f iled as par t of an MCCCD grievance, investigation or review, or other law ful request for the record. 20. Deleting or altering a technolog y record on an MCCCD device in anticipation or af ter receipt of a public records request, subpoena, or a complaint f iled as par t of an MCCCD grievance, investigation or review, or other law ful request for the record where the record may demonstrate a misuse of technolog y resources under this regulation. Review and Approval of Alternate E-Mail Account Systems The prior review and approval by the Vice Chancellor of Information Technology is required for the implementation of alternate College electronic mail account systems. Requests will be evaluated based upon the following considerations: 1. The s ystem must be compatible and interoperable with the MCCCD e-mail s ystem. All information within the e-mail s ystem must meet the standards and authorize Distric t Of f ice access as specif ied in Administrative Regulation 4.15, Retrieval, Disclosure and Retention of Records. 2. Any proposed changes to an MCCCD 's entit y 's e-mail s ystem with e- discover y implications must be approved in advance during the planning stages as specif ied in Administrative Regulation 4.15, Retrieval, Disclosure and Retention of Records. Complaints and Violations Complaints or allegations of a violation of these standards will be processed through Maricopa's articulated grievance procedures or resolution of controversy.
