General Information I. In accordance with the CSCPA , the MCCCD will provide on its Sex Of fender Information and Notif ication website, a link to the Arizona Sex Of fender Registr y website and instruc tions on how to access it. II. Arizona Revised Statutes require persons convic ted of any of the following 21 dif ferent of fenses to register as sex of fenders: 1) unlaw ful imprisonment if the vic tim is under 18 years of age; 2) kidnapping if the vic tim is under 18 years of age; 3) sexual abuse if the vic tim is under 18 years of age; 4) sexual conduc t with a minor; 5) sexual assault; 6) sexual assault of a spouse; 7 ) molestation of a child; 8) continuous sexual abuse of a child; 9) taking a child for the purpose of prostitution; 10) child prostitution; 11) commercial sexual exploitation of a minor; 12) sexual exploitation of a minor; 13) luring a minor for sexual exploitation; 14) ag gravated luring a minor for sexual exploitation; 15) unlaw ful age misrepresentation for the purpose of commit ting a sexual of fense 16) sex traf f icking of a minor; 17 ) a second or subsequent violation of indecent exposure to a person under 15 years of age; 18) a second or subsequent violation of public sexual indecenc y to a minor under the age of 15; 19) a third or subsequent violation of indecent exposure; 20) a third or subsequent violation of public sexual indecenc y; and 21) violations relating to the failure to register as a sex of fender. (See A .R .S. §13 -3821). III. The Arizona Depar tment of Public Safet y classif ies sex of fenders according to levels. The levels consist of Level 1: Low risk to the communit y, Level 2: Intermediate risk to the communit y, and Level 3: High risk to the communit y. IV. By law, Registered Sex Of fenders (R SO) are required to contac t the Maricopa Count y Sherif f 's of f ice or local police agenc y when they enroll in or are employed at a college — in either paid or unpaid status. (A .R .S. §13 -3821). a. Level Two and Level Three Of fender 's Obligation to Notif y the College: STUDENTS i. Current Students who are enrolled and receive their f inal classif ication or a change in classif ication as a Level 2 or Level 3 sex of fender during their period of enrollment must notif y the Campus Public Safet y Of f icer within f ive (5) business days of the star t of the semester. Campus Public Safet y Of f icers for each college and for the distric t of f ice can be found. The Campus safet y of f icer will schedule a meeting with the Dean of Students (or designee) and the Registered Sex Of fender student to take place within ten (10) days of the notif ication to Public Safet y. 1. Failure to comply with this procedure may lead to discipline under the Student Code of Conduc t as well as possible criminal penalt y as outlined in Arizona state law. ii. Potential Students who have been designated as a Level 2 or Level 3 sex of fender must notif y the Campus Public Safet y Of f icer to arrange a meeting when they intend to enroll at a College. Campus Public Safet y Of f icers for each college and for the distric t of f ice can be found at the MCCCD Police website. This meeting must take place at least ten (10) calendar days prior to the star t of classes. The meeting shall include the R SO, the Dean of Students (or designee), and the Campus Public Safet y Of f icer.) 1. A person who is classif ied as a Level Two or Three sex of fender has been admit ted to MCCCD and who has failed to timely to register pursuant to these procedures may be subjec t to discipline under the Student Code of Conduc t as well as possible criminal penalties as outlined in Arizona state law. EMPLOYEES iii. Current Employees who receive their f inal classif ication or a change in classif ication as a Level 2 or Level 3 sex of fender during their period of employment must immediately notif y the Campus Public Safet y Of f icer. The campus public safet y of f icer will arrange meeting with the Human Resources Manager (or designee) at the individual campus and the Registered Sex Of fender employee. Campus Public Safet y Of f icers for each college and for the distric t of f ice can be found at the MCCCD Police website. The meeting with the college human resources manager and the Campus Public Safet y Of f icer must take place within ten (10) days of the original notif ication to Public Safet y. iv. Potential Employees who have been classif ied as a Level 2 or Level 3 sex of fender must notif y the Campus Public Safet y Of f icer to arrange a meeting when they are of fered employment at the College. Campus Public Safet y Of f icers for each college and for the distric t of f ice can be found at the MCCCD Police website. This meeting must take place at least ten (10) calendar days prior to the star t of employment. The meeting shall include the R SO, the college human resources manager and the Campus Public Safet y Of f icer (or their designees). V. COLLEGE OFFICIAL S' MEE TING WITH LE VEL 2 OR LE VEL 3 SE X OFFENDER a. Af ter notif ication that a student or employee has been classif ied as a Level Two or Three Sex Of fender, MCCCD Public Safet y will collec t information from the R SO student or employee, probation/parole of f icer, Sherif f 's Of f ice, and/or arresting agenc y regarding the t ype of crime, conditions for probation, and/or level of risk.
