For Students: MCCCD Public Safet y will notif y the Dean of Student Af fairs (or designee) when a R SO has enrolled or expressed a desire to enroll at a MCCCD college. A representative from the Student Af fairs of f ice shall par ticipate in the required meeting with the R SO. i. An R SO identif ication must be placed in the Advocate online s ystem. The identif ication should include a summar y of the of fense/cour t- ordered conditions in place upon release, information from the parole/probation of f icer, and possible inter ventions needed at the college/Distric t level. c. For Employees: MCCCD Public Safet y will notif y Distric t and college Human Resources (or designee) when an R SO has registered due to being of fered employment with the MCCCD or is a current employee who has been classif ied as a Level Two or Three Sex Of fender. A representative from Distric t and the identif ied college's Human Resources depar tment shall par ticipate in the required meeting with the R SO. i. An R SO identif ication must be placed in the employee's personnel f ile. The identif ication should include a summar y of the of fense/ cour t- ordered conditions in place upon release, information from the parole/probation of f icer, and possible inter ventions needed at the college/ Distric t level. d. At the meeting referred to above, the student or employee who is classif ied as a Level Two or Three sex of fender will be advised of the following information: i. The College's knowledge of his/her f inal classif ication. ii. The College's obligation to provide public access to Level 2 & 3 sex of fender information through its Depar tment of Public Safet y. iii. Any restric tions that will be imposed on the sex of fender—based on any Cour t restric tions, restraining orders, or orders of protec tion that may be in place —and the duration of such restric tions. iv. If the of fender is classif ied at Level 3, he/she is fur ther informed of: 1. The College's polic y of posting notice at each college campus within t wo (2) days of receipt of the R SO 's information, regardless of when the meeting occurs. 2. The Level 3 R SO will receive a copy of the communit y notif ication the College intends to post. 3. The func tional areas of the College which will be provided with the public notif ication that will be posted. v. At any time, the Depar tment of Public Safet y can communicate with the of fender 's parole/ probation of f icer. VI. FERPA: The CSCPA fur ther amends the Family Educational Rights and Privac y Ac t of 1974 (FERPA) to clarif y that nothing in t he Ac t can prohibit an educational institution from disclosing information provided to the institution concerning the presence of registered sex of fenders. VII. ANNUAL AND OFF - CYCLE REVIEWS: Public Safet y and the Student Af fairs Dean (or designee) or Human Resources representative, depending on the status of the R SO, shall meet on an annual basis to review the conditions of enrollment, employment, and campus engagement. Additional, of f c ycle, reviews should be conduc ted when an R SO student or employee transfers within MCCCD or new information about criminal conduc t has been received. Distric t imposed conditions may be removed, added, or altered based on changes in enrollment location(s), legal case status, new criminal ac tivit y, and/ or disciplinar y standing. Both Public Safet y and Dean of Students or Human Resources professionals, for students and employees, respec tively, shall maintain documentation regarding all initial, annual, and of f- c ycle meetings and reviews. VIII. FAILURE TO NOTIF Y C AMPUS ADMINISTR ATION: Failure to notif y campus administration, as outlined in this procedure, of one's status as a R SO may lead to discipline up to and including removal from classes and/ or suspension from par ticipation in academic or ex tra- curricular programs, termination from employment as well as possible criminal penalt y as outlined in Arizona state law. IX . C AMPUS AND COMMUNIT Y NOTIFIC ATION OF RSO STATUS: Pursuant to Arizona law, the MCCCD shall make campus notif ications of R SO status, as follows: a. For level t wo and level three of fenders, the MCCCD Public Safet y Of f ice, in conjunc tion with the Public Safet y of f ice at each college will coordinate with the local law enforcement agenc y responsible for the individual communit y notif ications to ensure the sex of fender notif ication is provided to the individual campus communit y. b. The Sex Of fender Information and Notif ication website will host the notif ication of R SO 's employed by or at tending a MCCCD college, including employment with the Distric t of f ice. c. For Colleges with facilities of f-site from the main campuses that receive a registered sex of fender communit y notif ication f lyer from a local law enforcement agenc y, building managers are advised to post the f lyer the building 's common area easily accessed by students, staf f, and facult y for a at least thir t y (30) days. Specif ic information and instruc tions related to the communit y notif ication will be contained in the f lyer and such instruc tions should be followed. d. Any criminal ac tivit y involving a registered sex of fender should be repor ted to police. X . ADMINISTR ATIVE OVERSIGHT: a. Students: A campus administrator has the right to, at her or his discretion, require currently enrolled R SOs to at tend regular meetings. The meetings will
